Welcome to the TCS Nonprofit Storytellers Learning Lab. By accessing or using our platform, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
1. User Responsibilities
Account Security: You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.
Content Standards: You may not use our platform to post or share content that is illegal, harmful, or violates any third-party rights, including but not limited to copyright, trademark, privacy, and publicity rights. Content that is abusive, defamatory, obscene, or otherwise objectionable is strictly prohibited.
Respect for Others: You agree to interact respectfully with other members. Harassment, hate speech, or any form of bullying will not be tolerated.
Prohibited Activities: You agree not to engage in any of the following prohibited activities: (i) copying or distributing any part of the platform without our prior written authorization; (ii) using automated systems such as bots to access the platform; (iii) attempting to interfere with the security or integrity of the platform or its servers.
2. Membership Details
Payment: Membership fees are due at the time of registration and may be recurring depending on the plan selected. All payments are processed securely through our designated payment gateway.
Automatic Renewal: Your membership will automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date. You may update your payment information or cancel the auto-renewal through your account settings.
Cancellation: You may cancel your membership at any time through your account settings. Upon cancellation, you will retain access to the platform until the end of your current billing cycle, after which your membership will not be renewed. Please note that cancelling your membership will result in the loss of access to any Story Lab Kits you may have purchased or accessed during your paid membership period. To retain access to these resources, we encourage you to downgrade to a free membership instead of cancelling entirely.
Refunds: Refunds are issued at our discretion and typically are not available for recurring memberships unless otherwise specified. With the exception of Account Termination, as outlined below in which case no refunds are given, our refund policy is as follows:
Refund Policy
We’re committed to ensuring your satisfaction with our membership and products. Please review our refund policy below:
1. Membership Refunds:
Monthly Memberships: Refunds for monthly memberships are not available. You can cancel your membership at any time, and your access will continue until the end of the current billing cycle.
Quarterly Memberships: If you cancel a quarterly membership within the first 7 days of the new billing cycle, you may request a prorated refund for the remaining months of that quarter.
Annual Memberships: If you cancel an annual membership within the first 14 days of the new billing cycle, you may request a prorated refund for the remaining months of the year. After 14 days, no refunds are available, but you can cancel to prevent future charges.
2. Story Lab Kits:
All sales of Story Lab Kits are final. Due to the digital nature of our products, we do not offer refunds on any kits once purchased.
3. Special Circumstances:
We understand that situations may arise where a refund request falls outside of our standard policy. Please contact our support team, and we’ll be happy to review your case.
4. How to Request a Refund:
To request a refund for eligible purchases, please contact support with your transaction details. We aim to process all refund requests within 5-7 business days.
Account Termination: We reserve the right to terminate or suspend your account if you violate these Terms or engage in behavior that we determine, in our sole discretion, to be harmful to the community or platform.
Account Termination and Loss of Access to Purchased Materials:
Upon the deletion or termination of a member’s account, all access to previously purchased or accessed Story Lab Kits, as well as any associated content, will be permanently revoked. This includes but is not limited to any digital materials, project resources, and interactive content associated with the membership. The company shall not be held liable for the loss of access to any content resulting from voluntary account deletion or termination.
3. Liability
Disclaimer of Warranties: The TCS Nonprofit Storytellers Learning Lab is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of the platform or the information, content, or materials included.
Limitation of Liability: In no event shall we, our affiliates, or our licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the platform; (ii) any unauthorized access to or use of our servers; (iii) any interruption or cessation of transmission to or from the platform.
Third-Party Links: Our platform may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, so that the remaining provisions of these Terms will remain in full force and effect.
Dispute Resolution: Any disputes arising out of or relating to these Terms or your use of the platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive the right to a trial by jury or to participate in a class action.
Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the state of North Carolina, without regard to its conflict of laws principles.
4. Intellectual Property
Content Ownership: All content provided by the TCS Nonprofit Storytellers Learning Lab, including text, graphics, logos, and software, is the property of TCS or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or create derivative works from this content without our express written consent.
User-Generated Content: You are solely responsible for the content you post on the platform. We reserve the right to remove any content that violates our guidelines or these Terms. By posting content, you grant TCS a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your content in connection with the operation of the platform. You represent that you have the rights to grant this license for any content you submit.
5. Changes to the Platform
We reserve the right to modify or discontinue the platform or any of its features at any time, without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the platform.
6. Changes to Terms
Amendments: We may update these Terms of Service from time to time. Any changes will be effective immediately upon posting the revised terms on our platform. Your continued use of the platform following the posting of changes constitutes your acceptance of those changes.
